Germany: Mild sentence for asylum seekers after gang rape


ULM. In the case of gang rape of a 14-year-old girl, the Ulm Regional Court sentenced four asylum seekers on Monday. The court saw it as proven that the immigrants from Iraq and Afghanistan had raped the adolescent several times on Halloween night 2019, reports the news agency dpa.

Two of the defendants are now in prison for two years and three months. One was convicted of rape and dangerous physical harm, the other was convicted of rape on three counts. The other two are sentenced to two years and two months in prison for rape, aiding and abetting rape, and assault.

The 17 to 26-year-old men had been silent for most of the trial, which began in July 2020, according to the report. The presiding judge therefore assessed it as mitigating the punishment that they had partly commented on the offenses towards the end of the proceedings.

Penalties "almost at the bottom" of the sentence
The penalties against the asylum seekers are "almost at the bottom" of the sentence, the judge said when pronouncing the verdict. "There were doubts and there are still doubts." The trial was mainly characterized by the difficult interrogation of the victim. “In the course of the trial it turned out that the 14-year-old victim was no longer fully available for further questioning due to her psychological condition. Serious damage to health was to be expected upon further interrogation, ”a spokesman for the court told Junge Freiheit on Tuesday.

According to the indictment, the men persuaded the then 14-year-old to go with them to accommodation in Illertal. The girl had known one of them before. In the facility, they are said to have made the victim defenseless with narcotics and then abused them.

Originally, a 16-year-old Iranian was also charged. However, after the agreement on a perpetrator-victim settlement, the proceedings against him were discontinued. He is the victim's acquaintance.
