Germany: Afghan refugee who raped a 11-year-old girl is released because it is believed he was a minor at the time of the crime
According to Bild information, the crime happened on January 18th. Six months later the verdict: just one year in prison - on probation!
At the end of June, the perpetrator was found guilty on just one non-public trial day. And the prosecutor did not appeal. The Afghan was sentenced at the age of 16 because experts estimate him to be that old. He had not been able to show any identification documents.
He is said to have come to Germany as an unaccompanied refugee. Most recently he lived in accommodation in Neustrelitz.
So while the girl will suffer from this act for the rest of her life, her tormentor is at large.
Why is that allowed to be?
"I can more than understand that most citizens find this punishment too mild," says Philipp Amthor (CDU): "Of course, you always have to look at the circumstances of the individual case, but a suspended sentence for the rape of a eleven-year-old girl is hardly compatible with the public’s sense of justice.”
Hard to bear: A guilty verdict like this is not uncommon in such cases. "In the age structure, this mild sentence is not unusual," says defense attorney Burkhard Benecken.
"In the case of young offenders, the focus is on the idea of education." The chairman of the police union Rainer Wendt is appalled: "The rule of law has no protective effect in this way. I say that not only as a police union, but also as a father and grandfather.” CSU regional group leader Alexander Dobrindt to Bild: “Such a punishment is completely unacceptable for this crime.”
In fact, Khodai R. (23), who fled Afghanistan, was sentenced to two suspended sentences last year. In September 2018, R. raped a girl (11) with two accomplices.
Abominable: Just a month before his trial began, he molested a sleeping 13-year-old in February 2020.
