Environmental aid successfully sues German government: Is the climate lockdown now coming?


Success for “German Environmental Aid”: A court condemns the federal government to initiate “immediate measures” against climate change in the middle of the budget and financial crisis. Climate lobbyists already have concrete proposals.

Berlin - The Berlin-Brandenburg Higher Administrative Court has condemned the federal government to present an immediate program to reduce CO2 emissions. A lawsuit brought by “Deutsche Umwelthilfe” and BUND was upheld.

Background: The Federal Environment Agency had complained that the permissible annual emission levels in the areas of housing and transport were exceeded in 2021 and 2022. According to the judges, the 2023 climate protection program presented by the federal government is not sufficient.

Not yet legally binding
The court said that an immediate program must contain “short-term effective measures that ensure compliance with the annual emissions quantities specified in the Climate Protection Act for the following years in the respective sector.” The verdict is not yet legally binding.

“Deutsche Umwelthilfe” was very satisfied with the judge’s verdict. “This verdict is a double whammy for climate protection and a resounding slap in the face for the federal government because of its catastrophic climate policy,” said the association’s federal managing director, Jürgen Resch. He called for an immediate speed limit of 100 kilometers per hour on motorways and 30 per hour in towns, as well as a renovation offensive for daycare buildings.
