Berlin: Men are now allowed to transfer to the women's prison


Berlin is the first federal state to decide to soften the separation laws in prisons in order to improve prison conditions for alleged transsexuals. Men can be transferred to the women's prison - happy confinement for all involved.

According to the Berlin Senate, transgender, intersex and non-binary people should in future have a say in whether they want to be in prisons for men or women. The principle of "separate accommodation" should be deviated from in individual cases "taking into account the personality and needs of the prisoner, the achievement of the prison objective and the security or order of the institution". The amendment to the law is intended to apply in particular if prisoners "because of their gender identity, do not feel they belong to the gender stated in the official civil status entry, but to a different gender or permanently neither to the male nor to the female gender". Even trans women who have not yet changed their gender entry and name will then have the opportunity to serve their time in the women's prison.

Former justice senator Dirk Behrendt describes the change as a "prerequisite for a modern way of dealing with trans people in prison". After all, trans women have had to experience discrimination and violence in men's prisons in the past. However, little thought is given to the rights and protection of other inmates - according to the draft law, "the needs of the other prisoners" should also be taken into account, but how exactly this is to be implemented and what it actually means is not explained further and thus remains very much questionable.

The dangers for female inmates are very real when men only have to verbally state that they identify themselves as women in order to be transferred to a women's prison.

In recent years, there have been repeated cases of rape and sexual assault in women's prisons in the USA and Great Britain, committed by alleged trans women (biological men). The debate that the planned self-determination law, thanks to which everyone should be able to change their gender once a year by making a self-declaration, could increase the risk of abuse in Germany, was completely dismissed and demonized as right-wing, trans-, cross- or homophobic . Instead of giving serious thought to the consequences of "queer politics", the woke madness is pushed further and further. In New Jersey, a young man who identified himself as a woman recently impregnated two inmates, apparently consensually. In New York, on the other hand, there was a serious rape case in the women's prison in April, in which an alleged trans woman attacked and abused a fellow inmate in the shower rooms. In the UK in 2018, a convicted rapist was transferred to a women's prison to continue his work there. Prosecutors regretted the transfer after he molested two women and accused the man of only pretending to be trans to get near women and children.

Cases like these could also threaten Germany in the future with the change in the law in prisons and the introduction of the Self-Determination Act, but hardly anyone in politics and the media seems to be interested. On the contrary: When it comes to trans people, even left-wing feminists who advocate for the protection of women are now canceled and put in the right-wing corner.
